Lindenhurst Man Sentenced to 10 Years for Drugs and Weapon Possession

A Lindenhurst man has been sentenced to 10 years in prison for illegally possessing drugs and a weapon.

On February 20, 2021, David Marmol, 41, was stopped while driving a rented 2020 Ford Expedition by Suffolk County Police Department officers for a traffic violation in the vicinity of South Fifth Street and Montauk Highway in Lindenhurst. When officers approached the vehicle, they detected the odor of marijuana emanating from it. The officers subsequently searched the vehicle and recovered an illegal metal knuckle knife from the center console. Marmol was then arrested and taken to the First Precinct. Upon further search, it was discovered that Marmol was in possession of 20 bags of cocaine which collectively weighed approximately one-half ounce, as well as four bags containing heroin and fentanyl.

On December 2, 2022, Marmol was convicted by jury after a trial before Supreme Court Justice Timothy P. Mazzei on multiple charges, which include two counts of third-degree criminal possession of a controlled substance, seventh-degree criminal possession of a controlled substance, and fourth-degree criminal possession of a weapon. Marmol had previously been convicted of fifth-degree criminal sale of a controlled substance in 2000, second-degree robbery in 2001, and fifth-degree attempted criminal possession of a controlled substance in 2010. He was sentenced to 10 years in prison on July 11, 2023.

“This defendant’s prior convictions for drug dealing did not stop him from again being caught with illegal drugs packaged for sale,” said Suffolk County District Attorney Ray Tierney. “Hopefully this prison sentence will serve as a deterrent to those who think about continued criminal activity. My office is committed to working with law enforcement to ensure dangerous drugs and drug dealers are kept off the streets of Suffolk County.”
