An electric scooter rider from Westbury who was also wanted by Immigration and Customs Enforcement (ICE) was arrested for menacing and resisting arrest after failing to produce identification.
On November 22 at 5:11 p.m., Nassau County officers from the Bureau of Special Operations observed a male operating an electric scooter on the sidewalk in front of 215 Post Avenue in Westbury. Officers asked the subject for identification. The male allegedly declined to produce identification, became combative and refused to comply with the officers’ verbal commands. A struggle later ensued.
While placing the subject into custody, he allegedly became violent and allegedly swung his left closed fist at officers. After being warned, an officer utilized a Taser, subduing the subject.
Hector Hernandez Garcia, 42, was transported to an area hospital for evaluation and treatment.
Police charged Garcia with Menacing in the Third Degree, Resisting Arrest, Obstructing Governmental Administration in the Second Degree and Unlawful Operating a Scooter on Non-Highway. He was released on an appearance ticket and taken into custody by ICE agents.
