
In what can only be described as an alarming action by a rogue District Court judge, the president’s executive decision to deploy the National Guard was temporarily blocked.
The action was so over the top that even the radical 9th Circuit Court of Appeals overturned it.
The president unquestionably has the right to deploy the National Guard. It does not require a request or approval from the governor or any mayor. If that were the case, Presidents Eisenhower and Kennedy could not have deployed the Guard to oppose desegregation that was being practiced by those state governors.
The fact that a single judge can overrule a presidential order to keep our streets safe underscores how reforms are needed to prevent a single judge from overturning decisions from presidents of either party.
End this craziness now and adopt the provision I recommended in my book, Solutions to America’s Problems, that would require any such injunction to be imposed by a three-member panel and subject to an immediate review by the Supreme Court.
