Proposed Amendment

 

When NY State says 'Do Not Discriminate' it means DO NOT DISAGREE with the State—under Penalty of Law!

Current law already protects against discrimination based on race, sex, age, disability, and religion. New language is unnecessary.

Section 11 of Article 1 of the NY Constitution,

newly proposed changes to the Proposition are BOLD (Deletions are in brackets; Paragraph B is new.)

A. No person shall be denied the equal protection of the laws of this state or any subdivision thereof. No person shall, because of race, color, ethnicity, national origin, age, disability, creed [or], religion, or sex, including sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy, be subjected to any discrimination in (his or her) their civil rights by any other person or by any firm, corporation, or institution, or by the state or any agency or subdivision of the state, pursuant to law.

B. Nothing in this section shall invalidate or prevent the adoption of any law, regulation, program, or practice that is designed to prevent or dismantle discrimination on the basis of a characteristic listed in this section, nor shall any characteristic listed in this section be interpreted to interfere with, limit, or deny the civil rights of any person based upon any other characteristics identified in this section.

 
 
  • NO Minimum Age – These new classes & ‘rights’ apply to all minors.
  • In Prop-1, ‘Person’ means YOU, parent, guardian, clergy, counselor, teacher, business owner, non-profit volunteer.
  • New York State will have more authority than parents in making medical decisions for their children.
  • Vague, undefined language may erode current protections for church and organizations’ beliefs that run contrary to these new rights.
  • Adding these specific groups can leave out other groups. Is reverse discrimination’ allowed by Paragraph B?

Discrimination against certain groups in order to protect other groups (e.g., new classes in Paragraph A) may be lawful.
