A Wheatley Heights man was convicted following a trial of Endangering the Welfare of a Child. The defendant, an MRI Technician in Bohemia at the time, instructed a 16-year-old girl to strip from her waist down and pose in a suggestive manner for a routine MRI exam on her leg. The defendant was sentenced on August 13 by the court to a conditional discharge.
On October 1, 2023, the victim went for a routine MRI on her hamstring for a soccer injury at the Bohemia branch of Orlin & Cohen Orthopedic Group, where Robbie Baguio worked as a technician since 2022.
Prior to the scheduled MRI, Baguio instructed the victim to take off her shorts and underwear without providing any covering for the victim. The victim, having undergone a prior MRI with another technician without incident, questioned the defendant about the requirement.
Baguio repeated his instructions, and a medical gown was provided. The victim complied, removed her shorts and underwear and entered the MRI room in the medical gown. The medical gown was only tied at the neck, leaving the back exposed, unless manually held together.
At the start of the exam, Baguio instructed the victim to lie flat on her back inside the MRI machine and took several images. The defendant then claimed he did not obtain a sufficient image and instructed the victim to position herself facing downward on her hands and knees, to lower herself onto her forearms, raise her buttocks higher, and arch her back. The positions exposed her vagina and buttocks while inside the MRI machine.
Once the test was over, Baguio gave the victim a towel to cover herself. The victim promptly told her mother about the experience and the police were contacted.
Expert testimony at the trial proved that the poses instructed by the defendant were wholly unnecessary for a standard MRI procedure concerning a hamstring injury. Testimony further revealed that the images obtained while the victim lay flat on her back were sufficient for diagnosis and that no images were taken during the latter part of the exam.
Baguio, 37, was arrested on June 6, 2024, and waived his right to a jury trial, proceeding to a bench trial.
The bench trial began on August 5, 2025, before District Court Judge Eric Sachs, who returned a guilty verdict on June 11, 2026, on the sole count of Endangering the Welfare of a Child, a Class A misdemeanor.
On August 13, 2026, the defendant returned for sentencing. The District Attorney’s Office recommended that the defendant be sentenced to the maximum split sentence of 60 days
incarceration and three years’ probation, along with sex offender conditions and an order of protection. The Suffolk County Probation Department recommended a sentence of probation with alcohol and narcotics conditions.
Sachs sentenced the defendant to a conditional discharge with the mandatory surcharge and a stay-away order of protection for the victim.
“This defendant was convicted of endangering the welfare of a child for using his authority as a healthcare technician to prey on a young girl who was simply in need of a routine exam,” said Suffolk County District Attorney Ray Tierney. “I commend the brave young victim for coming forward and having the courage to confront the defendant’s actions in court.
