A Huntington Station man was indicted for allegedly possessing multiple illegal firearms without a proper license or permit to possess.
On May 14, pursuant to a lawful search of Matthew Hibner’s residence, law enforcement recovered four loaded illegal rifles, a Tramps Terror revolver, and two illegal ammunition magazines. Law enforcement also recovered materials used in firearm manufacturing, including gun tools, four pistol kits with instructions for assembling, unserialized lower and upper receivers, as well as all the tools and parts needed to assemble additional firearms.
Two of the four seized rifles and numerous lower and upper receivers that were seized allegedly do not have serial numbers or the name of a manufacturer as required by law.
Two of the ammunition magazines recovered are allegedly “large capacity” under New York law, meaning they can hold more than 10 rounds of ammunition.
The Suffolk County Crime Laboratory tested all the firearms and found them to be operable. Hibner allegedly does not have a permit, license, or any other legal authority to possess the weapons that were seized.
On June 4, Hibner, 36, was arraigned before Supreme Court Justice Philip Goglas on five counts of Criminal Possession of a Weapon in the Second Degree, Class C violent felonies, and three counts of Criminal Possession of a Weapon in the Third Degree, Class D violent felonies.
“It is alleged that this defendant possessed firearms and magazines that are illegal under New York law, including firearms that had no serial numbers,” said Suffolk County District Attorney Ray Tierney. “Responsible gun ownership is paramount to ensuring safety within our community, and we thank our law enforcement partners for their swift response in this case.”
Goglas ordered Hibner remanded during the pendency of the case. Hibner is due back in court on July 9 and faces up to 15 years in prison if convicted of the top count.
