Judge Releases Him Again before Sentencing
A Salvadoran national with a history of drunk driving arrests was found guilty of driving erratically with a blood alcohol content of 0.17, which is more than twice the legal limit. This conviction marks the defendant’s fourth DWI conviction within the past 10 years, with three of them — including this one — being felonies.
On November 29, 2025, at approximately 1:24 a.m., Pablo Aguilar-Alvarez got behind the wheel of a car after an evening of drinking. The defendant drove with his girlfriend to the USA Gas Station at the intersection of Flanders Road and Longneck Boulevard in Southampton to purchase additional alcohol. While inside the store, Aguilar-Alvarez’s girlfriend asked the clerk to call 911. The defendant and his girlfriend then drove away from the location.
After receiving the 911 call that included a description of the vehicle and the license plate, members of the Southampton Town Police Department located Aguilar-Alvarez’s vehicle. Officers witnessed Aguilar-Alvarez failing to stop at a stop sign and cross over the double-yellow center line on Longneck Boulevard before initiating a traffic stop.
When the vehicle came to a stop, Aguilar-Alvarez exited from the passenger side in an attempt to hide the fact that he had been driving. The defendant failed standardized field sobriety tests and consented to a chemical breath test, which revealed a blood alcohol content of 0.17%.
On August 7, 2026, Aguilar-Alvarez, 36, was convicted after a jury trial of one count of Driving While Intoxicated Per Se and one count of Driving While Intoxicated, both Class D felonies, and one count of Aggravated Unlicensed Operation of a Motor Vehicle in the Second Degree, an Unclassified misdemeanor.
Following the verdict, the District Attorney’s Office requested that Aguilar-Alvarez be remanded into custody as this was his third felony DWI conviction and the DA’s Office had reason to believe he was planning on fleeing from Suffolk County.
The Honorable Bryan L. Browns, County Court Judge, who presided over the trial, released Aguilar-Alvarez pending sentencing scheduled for October 2, 2026. The defendant faces up to 2-1/3 to seven years in prison.
“There is no question that Pablo Aguilar-Alvarez is a danger to society. Despite multiple prior felony DWI convictions, this defendant once again chose to get behind the wheel after drinking, putting everyone on the road at risk,” said Suffolk County District Attorney Ray Tierney. “And even now, despite the jury’s verdict, there is nothing to stop him from once again getting behind the wheel and endangering the lives of Suffolk County residents.”
Aguilar-Alvarez was previously convicted of the following crimes:
- Aggravated Driving While Intoxicated, a Class D felony, on June 16, 2022
- Driving While Intoxicated, a Class E felony, on October 11, 2017∙ Driving While Ability Impaired, Combined Drugs and Alcohol, a Class E felony, on April 19, 2017
- Driving While Intoxicated, an Unclassified misdemeanor, on May 14, 2012
Records indicate that Aguilar-Alvarez was deported from the United States on March 1, 2024, on the basis of his prior felony convictions, and he is currently here in this country illegally.
